Biden-Era Title IX Rules Formally Rescinded
The Trump Administration officially repealed President Biden’s Title IX regulations, issuing final rules that, effective immediately, recodify President Trump’s 2020 Title IX regulations. The action is largely a formality and will not change how colleges and universities comply with the law, as institutions have been governed by the 2020 rules since a court vacated the Biden-era regulations in 2025.
While the new rules make a few technical modifications to the 2020 version, they do not make any substantive changes. Despite observers’ concerns that controversial new provisions would be added, the rules notably omit any new provisions addressing gender identity discrimination. The Department of Education, however, continues to enforce the law based on its view that the prohibition against sex discrimination refers to biological sex, not gender identity, and has indicated that the topic may eventually be the subject of a future rulemaking.
